By accessing and using Picnic Island's website, mobile applications, and services (collectively, the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please discontinue use of our services immediately. These terms constitute a legally binding agreement between you and Picnic Island.

2. Account Registration and Use

To access certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. You must be at least 18 years old to create an account. Notify us immediately of any unauthorized use of your account.

3. Bookings and Reservations

When you make a booking through our Platform, you enter into a direct contract with the service provider (hotel, ferry operator, activity provider). We act as an intermediary to facilitate these transactions.

• Prices are displayed in USD and may be subject to change
• You must provide accurate guest and payment information
• Special requests are subject to availability and cannot be guaranteed
• Group bookings may be subject to different terms and conditions

4. Payment Terms

Payments are processed securely through our payment partners. By providing payment information, you authorize us to charge the total amount for your booking.

• Payment must be made at time of booking unless otherwise specified
• We accept major credit cards, debit cards, and approved payment methods
• All payments are processed in USD
• You are responsible for any applicable taxes, fees, or charges
• Currency conversion fees may apply for non-USD transactions

5. Cancellation and Refund Policy

Cancellation policies vary by service provider and booking type. The specific cancellation policy applicable to your booking will be clearly displayed before you confirm your reservation.

• Hotel bookings: Cancellation policies vary by property and rate plan
• Ferry tickets: May be non-refundable or subject to cancellation fees
• Activities and experiences: Typically require 24-48 hours notice for refund
• Package deals: Subject to the strictest cancellation policy of included services
• Refunds are processed to the original payment method within 7-14 business days

6. Ferry Services

Ferry services are subject to weather conditions, operational requirements, and safety regulations. Schedules may change without prior notice.

• Arrive at least 30 minutes before scheduled departure
• Valid identification is required for all passengers
• Luggage restrictions apply - check with your ferry provider
• We reserve the right to refuse boarding for safety or security reasons
• Weather-related cancellations will be rescheduled or refunded

7. User Conduct

You agree to use the Platform responsibly and in compliance with all applicable laws. Prohibited activities include:

• Making fraudulent or speculative bookings
• Attempting to gain unauthorized access to our systems
• Interfering with the proper functioning of the Platform
• Impersonating others or providing false information
• Using automated systems to access or scrape the Platform
• Engaging in any activity that violates these terms or applicable laws

8. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is the property of Picnic Island or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Limitation of Liability

Picnic Island acts as an intermediary between you and service providers. We are not responsible for the acts, errors, omissions, representations, warranties, or negligence of service providers. Our liability is limited to the maximum extent permitted by law.

• We are not responsible for delays, cancellations, or changes by providers
• We do not guarantee the accuracy of third-party information
• Our total liability shall not exceed the amount you paid for the booking
• We are not liable for indirect, incidental, or consequential damages

10. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, strikes, wars, or technical failures.

11. Privacy and Data Protection

12. Modifications to Terms

15. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
